Parties and Engagement

This agreement is entered into by Northwind Studio (the "Performer") and Acme Co (the "Presenter") for a live performance at the venue and on the date named on the acceptance page. It covers the show, technical needs, hospitality, and payment.

Recitals

The Presenter is engaging the Performer to appear at a live event described on the acceptance page. Both parties agree that a clear stage plot, honest tech advance, and hospitality basics done well are what make a professional show possible on the day.

Performance, Tech and Hospitality

The engagement runs across three areas the day of the show: technical, performance, and hospitality.

AREA 1 · TECHNICAL

Technical requirements

The Performer supplies an advance sheet including stage plot, input list, and monitor mix. The Presenter provides a house PA, stage, and lighting rig meeting industry-standard specs for the venue capacity, plus a qualified engineer for load-in through breakdown.

AREA 2 · PERFORMANCE

Show and billing

Two 45-minute sets with a 15-minute intermission. The Performer receives sole headline billing on all promotional material unless otherwise agreed in writing. Recording of the show is permitted only with the Performer's prior written consent.

AREA 3 · HOSPITALITY

Hospitality

A private dressing room with power, mirrors, and secure storage; hot meals for the Performer and touring party at load-in; bottled water and a light backline of snacks; and safe parking for the touring vehicle.

What is included

Two 45-minute performance sets on the confirmed date
One 60-minute sound check and technical advance call
Sole headline billing and standard promotional cooperation
Meet-and-greet of up to 30 minutes if requested

Not included: production above the specs on the advance sheet, additional performance time, travel outside the local area if not itemized, and merchandising fees (Performer retains 100% of merchandise sales).

Fees, Cancellation and Force Majeure

The engagement is a fixed guarantee. A deposit holds the date; the balance is due before the Performer takes the stage.

Payment Schedule

Cancellation

The deposit is non-refundable once received. If the Presenter cancels more than 60 days before the event, no further payment is owed. Cancellations within 60 days require 50% of the remaining guarantee; within 14 days, the full guarantee is due.

Force Majeure

Neither party is liable for failure to perform due to causes beyond reasonable control, including severe weather, illness, government restrictions, or venue closure. Both parties will make a good-faith effort to reschedule; if a reschedule cannot happen within twelve months, the deposit is retained and no further amounts are owed on either side.

About this template

The Performance Contract template is a five-page document for putting the arrangement on paper before it starts.
